В web2c это сделано через texk/web2c/tex.ch, в котором говорится: % Copying of this file is authorized only if either % (1) you make absolutely no changes to your copy, including name, or % (2) if you do make changes, you name it to something other than % "mltex.ch", "char_sub.ch", or "charsub.ch". То есть, я могу внести изменения и распространять их в файле, имя которого отличается от tex.ch, mltex.ch, char_sub.ch или charsub.ch.
